Partner Visa is a two stage visa which allows partners of Australian citizens and permanent residents to permanently live in Australia.
Partner Provisional Visa (Subclass 309)
This is the first stage of the visa application . This Provisional Visa allows the spouse or de facto to live temporarily with their partner temporarily. With this visa, applicant can stay in Australia temporarily until the Australian Government has decide on the outcome of the Permanent Visa (Subclass 100)
Partner Permanent Visa (Subclass 100)
This is the second stage of the visa application. It is granted to applicants who hold a Partner Provisional Visa and have an ongoing relationship with the partner who sponsors them. The processing time for the Permanent Visa starts after 2 years after the applicant applied for the Visa Subclass 309.
Applicant Requirements
- Be in genuine relationship with an Australian citizen or Permanent Resident who is willing to sponsor
- Over 18 years old
- Outside of Australia at the time of applying
- Meet the character requirements
- if not married, must meet the requirements for a ‘de facto’ partner
- No outstanding debts to the Australian government
- Visa and application has not been cancelled or refused before this application
Sponsor Requirements
- Required to provide the visa applicant with accommodation, financial support and child care
- Must be an Australian citizen and Permanent Resident
- Be over 18 years of old
- Need to be in a genuine relationship (marriage / de facto)
